Nevada Bill SB292 Brings Medigap for People with ESRD

Federal law requires insurers to offer Medicare Supplement (Medigap) plans in certain cases, but it doesn’t require them to sell to people with End-Stage Renal Disease (ESRD) under 65. However, a new state law entitled Nevada SB292 was signed into law on June 7, 2025, that changed those requirements, bringing Medigap for people with ESRD. Here’s what you should know.

SB292: Changing Medigap Requirements

Anyone can sign up for Medicare when they turn 65. However, some people with disabilities or end-stage renal disease (ESRD) may be able to sign up for Medicare early because of their conditions.

But just because they can sign up for Medicare doesn’t mean they can get a Medicare Supplement (Medigap) plan, which provides extra coverage to “fill the gaps” Medicare doesn’t cover. Because until SB292, insurers weren’t required to provide Medigap for people with ESRD or other disabilities under 65.

With the passing of Nevada State Bill 292, people under 65 on Medicare due to disability or ESRD can now get a Medicare Supplement plan on the same terms as those 65+.

Impact of SB292 in Nevada

Naturally, the biggest impact of Nevada SB292 is that insurers must now offer Medigap for people with ESRD. This is a huge step for providing more affordable healthcare to people with serious chronic illnesses like end-stage renal disease.

In addition to offering Medigap for people with ESRD, insurers cannot hike premiums above what’s allowed for 65+ Medigap enrollees. This limit keeps Supplement premiums affordable for those under 65 with disabilities or ESRD.

And even with a limit on premiums, SB292 prohibits insurers from adding terms or conditions beyond what’s applied to 65+ enrollees. They can’t put extra restrictions on Medigap for people with ESRD under 65. It must be the same plans offered to those 65+.

How to Get Medigap for People with ESRD

If you’re under 65 and on Medicare because of a disability or end-stage renal disease, you may now qualify for a Medicare Supplement plan for additional coverage. Just like regular Medicare, SB292 establishes open enrollment periods for under-65 enrollees.

The first open enrollment begins with a 6-month window starting when someone first enrolls in Medicare Part B. For people with ESRD, this may be before they turn 65. During this time, there can be no denials, rate hikes, or preexisting condition exclusions. Essentially, if you apply, you’re accepted.

Because SB292 is brand-new, there’s a one-time open-enrollment period that runs between October 1, 2025 – April 1, 2026, for those under 65 and are already enrolled in Medicare Part B because of a disability or ESRD as of October 1, 2025.
